The petitioner seeks bail in Uphara P.S. Case No. 37 of 2018, instituted for the offence under Section(s) 406 and 420/34 of the Indian Penal Code.
It is alleged in the written report filed by informant that in Kharif season 2017-18 Uphara and Hasanpur PACS purchased 1690 and 2209 quintal of paddy from the farmers. It is further alleged that till 31.7.2018 Uphara PACS supplied 540 quintal of CMR against 1132.30 quintal and Hasanpur PACS supplied 1080 quintal of CMR against 1480.03 quintal respectively. It is further alleged that Uphara and Hasampur PACS have sold CMR valued at Rs. 13,70,346.26 and Rs.9,25,442.53 in the open market and embezzled public
Patna High Court Cr.Misc. No.9874 of 2019(2) dt.19-02-2019 2/2 money.
Counsel for the petitioner submits that petitioner was the Manager of Uphara PACS. The alleged money has already been deposited by the Chairman of the aforesaid PACS namely, Shree Niwas Sharma who has already been granted bail by coordinate Bench of this Court vide order dated 25.01.2019 passed in Cr. Misc. 3630 of 2019.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Uphara P.S. Case No. 37 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
