As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 02.03.2021, within four weeks of starting of Court proceeding in physical mode in normal course. Learned counsel appearing on behalf of petitioner submits that the prayer for pre-arrest bail of the petitioner was refused by this Court on 10.06.2020 passed in Criminal Miscellaneous No. 81176 of 2019 with direction to the petitioner to surrender before the trial Court, in connection with Kuchaikot P.S. Case No. 228 of 2019, pending in the Court of learned Addl. Sessions Judge-II-cum-Special Judge (Excise), Gopalganj, within four weeks from today and pray for regular

Patna High Court CR. MISC. No.18739 of 2021(2) dt.28-07-2021 2/2 bail, which shall be considered by the trial Court in accordance with law without being prejudiced by the order of this Court, but, petitioner could not surrender before the trial Court within the stipulated time due to pandemic of Covid-19. In such view of the matter, let the time to surrender of the petitioner as ordered on 10.06.2020 passed in Criminal Miscellaneous No. 81176 of 2019 be further extended by eight weeks from today.

Accordingly, the modification application is allowed and the order dated 10.06.2020 passed in Criminal Miscellaneous No. 81176 of 2019 is modified to the above extent. Accordingly, this application stands disposed of. (Rajendra Kumar Mishra, J) manish/- U T
