====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 18-10-2024 Heard Mr. Raj Kumar, learned counsel for the petitioner, Mr. Arun Kumar Pandey, learned counsel for the informant and learned APP for the State.
2. The petitioner is apprehending his arrest in connection with Mahila P.S. Case No. 47 of 2023 for the offence under sections 341, 323, 504, 498(A), 494, 354A and 34 of the IPC, lodged on 10.08.2023 by the informant, Puja Mishra.
3. As per the prosecution story, the informant alleged that her marriage took place with the petitioner in the year 2019 but they were not happy with the dowry that they received and for which she was mentally and physically harassed. The allegation is that one of the harassment was that whenever her

As the torture continued and she was beaten black and blue after taking all the ornaments, she left the place without any money and even the auto which was hired by her, the payment was made by her sister-in-law. She gave birth to a son but despite information, no one came. She further checked the Facebook and saw the profile of the petitioner with a lady beside him with ornaments and accordingly, the FIR.
4. In this case, both the Co-ordinate Benches and this Court tried to prevail upon the couple to come to an amicable settlement and the matter was sent to the Mediation Centre also. The report of the Mediation Centre is on record, according to which, the same failed.
5. Learned counsel for the petitioner tried to make several allegations against the lady that she has disappeared with her beloved, even the son does not belong to him.
6. Learned counsel for the informant submits that the submission clearly shows as to how she was mentally and physically harassed and despite within a year of the marriage, she gave birth to a male child, now after years, aspersions are being cast on the arrival of male child.
7. Considering the allegation that has come against
