Mr.Nitya Nand Tiwary ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-07-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Special Case (Excise) No.10842 of 2018, arising out of Bihta P.S. Case No.1280 of 2018, registered under Section 30(A) of the Bihar Prohibition Excise Act, 2016.

The accusation is that in course of patrolling duty by the police, a vehicle bearing Registration No.DL 9C-4108 was seen, moving in high speed, then the informant along with other police personnel chased the vehicle, whereupon two persons succeeded to flee away after getting down from the vehicle, while two persons were apprehended, who disclosed their name as Navin Kumar and Sandeep Kumar. On search, 288 bottles, each containing 750 ml.

Patna High Court CR. MISC. No.8804 of 2019(4) dt.08-07-2019 2/2 Indian Made Foreign Liquor, were recovered from the vehicle. The apprehended accused also disclosed the name of the petitioners, who succeeded to flee away.

Learned counsel for the petitioners submits that the petitioners were not apprehended on the spot rather their name has been disclosed by the apprehended accused. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge Excise, Patna, District-Patna, in connection with Special Case, Excise No.10842 of 2018, arising out of Bihta P.S. Case No.1282 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
