In this case, petitioners are seeking bail in connection with Barahara P.S. Case No. 101 of 2015 registered for offences under sections 147, 148, 149, 302, 120(B) and 379 of the Indian Penal Code.
As per the allegation made in the first information report, the petitioner and others came to the field and started/resorted firing. At the same time, the informant and others tried to hide themselves in the bundle of wheat. Meantime, Baleshwar Rai fired from the gun whereupon informant's father died other accused persons fled away from that place.
Patna High Court Cr.Misc. No.51160 of 2015 (2) dt.10-11-2015 2/2 There is a direct allegation against Baleshwar Rai. Allegation has been made that the petitioner is one of member of the accused persons and he was present at the time of resorted firing.
Looking to the nature of allegation, let the petitioners, above named, be released on bail in 1st last week of January, 2016 on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Barahara P.S.
