JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-06-2020 Heard Mr. Harish Kumar, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Revilganj P.S. Case No. 351 of 2019 dated 13.11.2019 instituted for the offences under Sections 188, 272 and 34 of the Indian Penal Code and Sections 30/38/41 of the Bihar Prohibition and Excise Act.
It appears that several hundred litres of liquor was recovered from a truck. The driver of the truck who was arrested by the police disclosed that the consignment was to be delivered to four persons including the petitioner.
Hence the prosecution of the petitioner.
Learned counsel for the petitioner has
Patna High Court CR. MISC. No.7684 of 2020(2) dt.10-06-2020 2/2 submitted that the petitioner is a person of clean antecedent and the consignment was never ordered by him. He has unnecessarily been named in the FIR. Regard being had to the aforesaid facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran in connection with Revilganj P.S. Case No. 351 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
