JUSTICE SATYAVRAT VERMA ORAL ORDER 15-02-2023 Heard Shri Yogesh Chandra Verma, the learned senior counsel for the petitioner and learned A.P.P. for the State. Learned senior counsel for the petitioner submits that earlier the bail application of the petitioner was rejected vide order dated 06.01.2023 in Cr. Misc. No. 20572 of 2022. However, the petitioner was granted liberty to renew his prayer for bail after framing of charge. It is next submitted that charges now have been framed on 20.01.2023 as would be evident from Annexure-3 to the bail application, further the petitioner is a senior citizen aged about 65 years and is in custody since 22.01.2022.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

No.9630 of 2023(2) dt.15-02-2023 2/2 Considering the submissions made by the learned Senior counsel for the petitioner and the fact that charges have been framed in pursuance whereof the present bail application has been filed, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with S.Tr. No. 309 of 2022 arising out of Jamo Bazar P.S. Case No. 06 of 2022 with a condition that one of the bailors of the petitioner shall be his son, Rahul Kumar.

However, if the learned trial court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned trial court would be at liberty to cancel his bail bonds after recording reasons. (Satyavrat Verma, J) Rishi2/- U T
