The petitioner seeks bail in connection with Maharajganj P.S. Case No.29 of 2015 registered under Sections 341, 323, 324, 379 and 307/34 of the Indian Penal Code. The accusation is that the petitioner alongwith his wife, daughters and mother-in-law caused injury to the informant, Manju Devi, and her daughter through 'Farsa' and 'Lathi' on their head and also committed the theft of the households articles from the house of the informant.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner and the informant are gotiyas
Patna High Court Cr.Misc. No.51407 of 2015 (2) dt.21-12-2015 2/2 and due to family dispute the alleged occurrence took place in which the persons from both sides sustained injuries. It is further submitted that on the basis of the written report of Bimal Devi, the wife of the petitioner, the counter case bearing Maharajganj P.S. Case No.30 of 2015 under Sections 341, 323 and 504 of the Indian Penal Code was registered against the informant. Further submission is that while three injuries were found on the person of the informant but out of them, two are simple in nature whereas one injury found on the occipital region of the informant is grievous in nature. The petitioner is in jail custody since 06.09.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Maharajganj P.S. Case No.29 of 2015.
