Petitioner is accused in connection with Kothi P.S. Case No. 07 of 2013 registered under Sections 304/34 of the I.P.C. and 3(ii)(v) of the S.C./S.T. (prevention of atrocities) Act. The accusation is that this petitioner along with Shamim Khan and Chotan Khan accompanied Chhotu, husband of the informant for some work. In the evening, the informant came to know that her husband died due to electric current. Thereafter, she went there and came to know that her husband was compelled to climb on the electric pole by Shamim Khan, Chotan Khan and this petitioner for connecting the wire of 11000 voltage, but he came in contact of high voltage and died due to electrocution.

No.51413 of 2015 (2) dt.21-12-2015 2/2 Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the deceased, husband of the informant had gone to connect the broken wire of 13000 voltage, which was fallen due to cut of tree of co-accused. Since the petitioner was with the co-accused, he has falsely been implicated in this case. It is also submitted that petitioner is in custody since 27.08.2015.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M., 1st Class, Sherghati, Gaya in connection with Kothi P.S. Case No. 07 of 2013.
