====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 20-03-2024 Heard Mr. Suraj Narain Yadav, learned counsel appearing on behalf of the petitioner and Mr. Rajendra Prasad Nat, learned APP for the State.

2. The petitioner has filed the present application for modification of the order dated 04.01.2022 passed in Cr. Misc. No. 39136 of 2021.

3. Learned counsel appearing on behalf of the petitioner informs that petitioner was granted bail vide order dated 04.01.2022 passed in Cr. Misc. No. 39136 of 2021, however, bail bond of the petitioner was not accepted considering the fact that the same day present F.I.R. being Charpokhari P.S. Case No. 01 of 2021 was lodged in which the

Patna High Court CR. MISC. No.12664 of 2024(2) dt.20-03-2024 2/2 petitioner has been granted bail, another F.I.R. being Charpokhari P.S. Case No. 02 of 2021 was also lodged against the petitioner and the same could not be informed to this Court by making statement in this regard in Para-3 of the bail application and, as a consequence of the same, bail bond of the petitioner could not be accepted.

4. Considering the information given in this regard in Para-7 of the modification application, I am of the opinion that the petitioner has, prima facie, made out a case to be released on bail.

5. The petitioner, above named, is directed to be released on bail on similar terms and conditions as contained in order dated 04.01.2022 passed in Cr. Misc. No. 39136 of 2021.
