The petitioner is languishing in custody since 26.8.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

It is alleged that co accused Bhola Sahni assaulted with brick, petitioner assaulted with bamboo and Mala Devi assaulted with fists and slaps to deceased Dashrath Sahni who subsequently succumbed to the injury.

It is submitted by the learned counsel for the petitioner that postmortem report reflects no external or internal injury and the cause of death has been found to be serious chronic pulmonary fibro tic discern. The final form has been submitted vide Charge Sheet No. 171 of 2014 under sections 341,323 and 304/34 IPC. Statement has been made in paragraph 3 of the petition that the

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Rosera, Samastipur in connection with Bibhutipur P.S. Case No. 98 of 2014. (Dinesh Kumar Singh, J) Anil/- U T
