The petitioner seeks regular bail in connection with Mainatand PS case no. 111 of 2018 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

The allegation is regarding recovery of 150 liters of illicit nepali liquor from four bags said to have been thrown on the road, however the petitioner was apprehended while he was throwing away the bags.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having clean antecedent and he is languishing in custody since 15.09.2015.

Patna High Court Cr.Misc. No.8645 of 2019(2) dt.14-02-2019 2/2 Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, (Excise), Bettiah at West Champaran in connection with Mainatand PS case no. 111 of 2018.
