The petitioner seeks bail in connection with Taraiya P.S. Case No. 91 of 2015 registered for the offences punishable under Sections 376(D) of the Indian Penal Code and Section 3, 4 of POCSO Act.
Allegedly the petitioner and co-accused committed rape one after another with the informant.
Submission is of false implication and that medical evidence does not support the prosecution version to which the learned A.P.P. opposes by submitting that several witnesses have supported and the doctor has also stated that victim may have intercourse.
Patna High Court Cr.Misc. No.51540 of 2015 (3) dt.08-01-2016 2/2 In the facts and circumstances stated above, this Court is not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected.
However, petitioner may renew his prayer after examination of the victim in the Court.
