====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 17-03-2020 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case instituted for the offences under Sections 324, 307, 353, 224, 511, 120(B) of the Indian Penal Code, Sections 3 and 5 of Explosive Substance Act, 25(1-b)A, 26, 27, 35 of the Arms Act and 7, 8 and 13 of Prevention of Corruption Act.

The prosecution case in short is that the accused persons hatched conspiracy and exploded bomb and made attempts to release the prisoners from the prisoners' van due to which police personnel sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.7.2018. There is no allegation of

Patna High Court CR. MISC. No.8909 of 2020(3) dt.17-03-2020 2/2 tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. Three accused persons along with others were taken to Patna Civil Court for production. The name of the said persons are Md. Aslam @ Kalakwa, Sonu Kumar and Sikandar Rai. While the aforesaid accused persons were returning from the Court, bomb exploded in the police vehicle and the aforesaid accused persons tried to flee away from the police custody. It is alleged that petitioner and others are suspected to have helped the aforesaid persons. Except for this, there is no other substantive evidence to suggest his participation in the present case. Other co-accuseds, similarly situated, have been granted bail vide Annexure-2 series to the present application. On behalf of the State and the Vigilance, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, Patna in connection with Beur P.S. Case No. 146/2018 (Special Case No. 47/2018).
