====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-01-2022 Heard Mr. Arun Kumar, learned Advocate for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Kanti P. S. Case No. 196 of 2020 instituted for the offences under Sections 341, 323, 307, 354, 354B, 504 and 506/34 of the Indian Penal Code.

The petitioner and his father are alleged to have gone to the house of the informant and hurled abuses. The daughter of the informant is said to have been assaulted by the petitioner. She was also subjected to disgrace by the father of the petitioner.

Learned counsel for the petitioner has submitted that there is another reason for this false accusation. In fact, the mother of the petitioner had lodged a case against the informant

Patna High Court CR. MISC. No.19431 of 2021(2) dt.11-01-2022 2/2 and others of the subject F.I.R. vide Kanti P.S. Case No. 205 of 2020 with respect to an occurrence dated 01.04.2020 in which there is an accusation of assault on the petitioner and his father. Both sides have received injuries but the injuries suffered by the daughter of the informant is stated to be simple in nature.

Regard being had to the facts afore-stated, the petitioner is directed to be released on bail, in the event of his/her arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, on his/her furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, West, Muzaffarpur in connection with Kanti P. S. Case No. 196 of 2020, subject to the condition as laid down under Section 438 (2) Cr. P.C. The application stands allowed.
