The petitioner seeks bail in Town P.S. case no. 535 of 2015, registered for the offence punishable under Sections 419,420,468,471/34 of the IPC.

The District Transport Officer got a search made of the kiosk near the office of the District Transport office. One kiosk allegedly belonging to the petitioner was searched and several rubber stamps and seals etc. were found. It is alleged that the petitioner was involved in issuing fake certificate/attestation. It is submitted that the petitioner is a registered advocate clerk of a lawyer. He has no criminal antecedent. He is in custody since 29.09.2015. The charge sheet upon investigation has already been submitted.

Learned APP for the State on going through the case

Patna High Court Cr.Misc. No.51593 of 2015 (3) dt.14-12-2015 2/2 diary has also submitted that no criminal antecedent of the petitioner has been noticed and recorded.

Considering the facts and circumstances of the case, this Court is inclined to extend the privilege of bail to the petitioner. Let the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Town P.S. case no. 535 of 2015, with following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.

(ii) As soon as the charges are framed the petitioner shall appear in person before the trial court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive dates, the trial Court shall have liberty to cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
