====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Sasaram (T) P.S. Case No. 1075 of 2019 for the offenses under Sections 414 and 420 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Allegation against the petitioner in the instant case is that he was involved in purchasing of stolen motorcycle. Learned counsel for the petitioner further submits that the petitioner is not aware of the fact that the motorcycle was stolen one. The petitioner is in custody since 09.12.2019.

Considering the fact that the petitioner has no criminal antecedent and he claims to have purchased the motorcycle

Patna High Court CR. MISC. No.7717 of 2020(2) dt.05-02-2020 2/2 without knowledge of the fact that it is stolen one, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (T) P.S. Case No. 1075 of 2019.
