The petitioner apprehends his arrest in Rajnagar P.S. Case No. 73 of 2018, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and section 3/4 of the Prevention of Damage of Public Property Act.

Prosecution case in brief is that on the alleged date and time of occurrence, it is alleged that 100-150 people attacked on the police party with lathi, danda, as a result of which several persons including police personnel became injured. It is further alleged that they also burnt the vehicle of Malkhana and started pelting stones on the police station and

It is submitted that though, petitioner is named in the FIR, but no specific overt act has been alleged against this petitioner. Similarly situated co-accused have been granted bail by different benches of this court. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Madhubani in connection with Rajnagar P.S. Case No. 73 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
