JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-04-2019 This is an application for grant of anticipatory bail in connection with Sarmera P.S. Case No. 113 of 2017, disclosing offences under Sections 302, 201, 34 of the Indian Penal Code. Allegation as per F.I.R. is that the Devar of the informant was living at Jalandhar and he was in love with a girl of Mohaddipur and her Devar used to give her money. Further allegation is that on the eve of Chhatt Puja, her Devar had come to her house and he used to go to the house of the girl and on the day of occurrence, the wife of the petitioner called her Devar to her house, but he did not return and thereafter they started searching him and in course of search, his dead-body was found and on enquiry from the family members of the girl, they disclosed that Manish Kumar died due to snake bite, but they have not given any information of the same.

No.9038 of 2019(4) dt.23-04-2019 2/2 Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case which will appear from the fact collected during the course of investigation that the deceased has consumed poison and due to which, he died and only on suspicion, the petitioner has been made accused in this case.
Heard learned A.P.P. also, who has also not controverted the above fact.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Nalanda at Biharsharif, in connection with Sarmera P.S. Case No. 113 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
