The petitioner seeks bail in anticipation of his arrest in connection with Tajpur (Halai O.P.) P.S. Case No. 237 of 2020, dated 30.06.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

In view of the petitioner having been made accused earlier also in the same nature of case, I am not

Patna High Court CR. MISC. No.19032 of 2021(4) dt.27-01-2022 2/2 inclined to exercise my discretion for grant of anticipatory bail to him.

The prayer for grant of anticipatory bail to the petitioner is, accordingly, rejected.

However, if he surrenders before the Court below and seeks bail, it shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.

The application stands dismissed.
