JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-12-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Muffasil P.S. Case No. 83 of 2015 registered under Sections 302 and 201/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation the motorcycle has been recovered nearby the place of occurrence, which was found in the name of Rakesh Kumar, who stated about selling the motorcycle to Kamlesh Kumar and Kamlesh Kumar stated about selling the said motorcycle to this petitioner. It is further submitted that, in fact, the petitioner is not the owner of the

Patna High Court Cr.Misc. No.50950 of 2015 (2) dt.18-12-2015 said motorcycle nor he purchased the said motorcycle as stated by the Kamlesh Kumar. It is further submitted that petitioner has no criminal antecedent and is in custody since 12.05.2015. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Muffasil P.S. Case No. 83 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
