The allegation against the petitioner is that the petitioner assaulted the informant Sanjay Rai with lathi on his head. The doctor found one incised injury on the head, but opined that the injury is simple in nature.

The learned A.P.P. has submitted that the occurrence took place, as the petitioner was pressurizing to withdraw the case.
