Petitioner seeks bail in Bhabhua P.S. Case No. 644 of 2018 registered for the offence punishable under Sections 25(1-B)A, 26 and 35 of the Arms Act and under Sections 379 and 411 of the Indian Penal Code.
Allegation is of recovery of one rifle and 17 live cartridges from the bed of the petitioner.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to enmity. Nothing has been recovered from his possession. He is in custody since 07.09.2018.
Considering the recovery and antecedent of the petitioner, I am not inclined to enlarge the petitioner on bail at this stage, hence, the prayer for bail of the petitioner is hereby
Patna High Court CR. MISC. No.9182 of 2019(3) dt.05-03-2019 2/2 rejected.
However, it is observed that petitioner may renew his prayer for bail, after one year of jail custody. (S. Kumar, J) manoj/- U T
