15-12-2015 Heard Sri Ajay Kumar Sinha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 31-07-2015 in Mahendia P.S. Case No. 91 of 2015 registered for the offence under Sections 420, 406, 34 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that despite the fact that before obtaining loan, the petitioner had mortgaged his land, instead of initiating a proceeding for recovery of the loan amount under the Public Demand Recovery Act, the bank directly filed a criminal case and the petitioner is in custody since long.

In view of nature of accusation and period of custody,

Patna High Court Cr.Misc. No.53026 of 2015 (2) dt.15-12-2015 2/2 let the petitioner namely Vijay Singh @ Vijay Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal/concerned court in connection with Mahendia P.S. Case No. 91 of 2015.
