Earlier prayer for bail of the petitioner was twice rejected by this court and while rejecting prayer for bail of this petitioner on 8.1.2014 passed in Cr. Misc. no. 39590/2013 this court directed the trial court to conclude the trial of the petitioner within nine months from the date of receipt/production of the above stated order but it is matter of shocking that except framing of the charge, nothing could be done in the above stated case.

Petitioner is said to have given one dagger blow on the chest of the deceased.

Admittedly, petitioner is in jail custody since 13.9.2011 without any progress in trial.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on

Patna High Court Cr.Misc. No.50558 of 2014 (3) dt.11-02-2015 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge II, Saran at Chapra in Sessions trial no. 6/2012 arising out of Ekma P.S. Case no. 99/2011.
