JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioners seek bail in connection with Puraini P.S. Case No. 57 of 2014 registered for the offence punishable under section 302 read with 34 of the Indian Penal Code. It has been contended that the case was registered against unknown and in course of investigation apart from wild suspicion and hypothetical presumption, there is no other legal material to connect the petitioners with the alleged offence. Learned counsel for the State as well as learned counsel for the informant has submitted that there is strong suspicion against the petitioners and the case is based on circumstantial evidence.

No.51753 of 2014 (3) dt.03-03-2015 2/2 Be that as it may, having regard to the facts and circumstances of the case, both the petitioners, namely, Madan Sharma and Bilash Sharma are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Puraini P.S. Case No. 57 of 2014.
