In the circumstances, the prayer for condonation of delay is allowed.

The Petitioner was convicted by the judgment dated 17.08.2013 passed by the Judicial Magistrate, 1st Class, Aurangabad in G.R. No. 178 of 2011 (Tr. No. 892 of 2013) for the offences under Section 25(1-B) A of the Arms Act and sentenced to RI for three years and fine of Rs. 1,000/- and under Section 26(i) of the Arms Act sentenced the same. In appeal the 2nd Additional Sessions Judge, Aurangabad in Cr. Appeal No. 81 of 2013 confirmed the conviction but reduced the sentenced to one year and fine of Rs. 1,000/- each and in default of which further three months imprisonment.

Patna High Court CR. REV. No.81 of 2015 dt.26-02-2015 The Petitioner submits that he is in custody since 13.11.2014 and he has no criminal antecedents. Considering such aspects of the matter, the Revision Application is dismissed but with modification in sentence of the Petitioner to one already undergone by him during Trial and the order of fine imposed by the Trial Court against the Petitioner is, hereby, set aside.
