The petitioner is in custody in connection with Amarpur P.S. Case No. 183 of 2018 for the offence under Sections 366 (A)/34 of the Indian Penal Code and after investigation Police has submitted Charge Sheet under Section 366 (A), 376 of I.P.C. and 4, 8, 12 of POCSO Act. Learned counsel appearing on behalf of the petitioner submits that petitioner and the victim have joined wedlock and also they have entered into compromise.
Considering the compromise i.e. Annexure P/2, it appears that parties have entered in marital relationship, the Court is inclined to grant bail to the petitioner, subject to the conditions that Court below at the time of release of the
Patna High Court CR. MISC. No.11587 of 2019(2) dt.26-02-2019 2/2 petitioner once again record the statement of victim in order to verify the fact that parties have joined marital relationship or not. In the event the informant admits the relationship between the petitioner and victim the Court below shall release the petitioner on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned A.D.J., 1st, Banka, in connection with Amarpur P.S.
