JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 27.9.2014 in a case initially registered for the offences punishable under Sections 341,323 and 307/34 of the Indian Penal Code. Subsequently section 302 IPC was added.
It is alleged by the informant Jagdish Bhulla that while he was in the brick kiln he was assaulted by Shambhu Yadav, Kapil Yadav and the petitioner with lathi when he became unconscious. The informant also admitted that due to night he did not lodge the case but it was lodged next day. It is submitted by the learned counsel for the petitioner that considering the general and omnibus allegation, co accused have been granted bail vide Cr. Misc. Nos. 39237 of 2014 and 54429 of 2013. Statement has been made in paragraph 3 of the
Patna High Court Cr.Misc. No.51731 of 2014 (2) dt.05-01-2015 2/2 petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Kawakola P.S. Case No. 33 of 2013.
