The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code.
It has been contended on behalf of the petitioner, who claims to have involved only in one case except the present one, that F.I.R. is against four unknown persons, however, his name has come up on the confessional statement made by co-accused, Ravi Ranjan Kumar. He claims that he has not been put to Test Identification Parade also.
Having regard to the facts and the circumstances of the case, the petitioner, Santosh Choudhary, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-
Patna High Court Cr.Misc. No.52468 of 2015 (2) dt.15-12-2015 2 / 2 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, District Sitamarhi in connection with Bathnaha P.S. Case No.356/14 with a further condition that one of the bailors of the petitioner must be the close relative or his family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioner. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
