The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 406 and other allied sections of the Indian Penal Code. As per the prosecution case, all the FIR named accused persons including petitioner along with 8-10 persons have executed forged and fabricated sale deeds on the basis of manipulated forged documents in the favour of informant's side. It is submitted that as per the FIR petitioner has executed 06 katha land bearing Khata No. 18, Khesra No. 10/141 through Registered Sale deed/Kabala vide Deed No. 270 dated 09.01.2018 in favour of informant Bihar Lal Goswami and informant mutated said land in his favour and is in

Patna High Court CR. MISC. No.9821 of 2023(3) dt.23-06-2023 2/2 peaceful possession. It is further submitted the dispute is purely of civil nature. Similarly situated co-accused have been granted bail by this Court vide order dated 03.08.2021 passed in Cr. Misc. No. 22918 of 2021. Petitioner claims clean antecedents. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Dumrao P.S. Case No. 127 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
