JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 The petitioner seeks regular bail in connection with Sitamarhi P.S. Case No. 521 of 2019, registered for offences punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 60.930 litres of foreign liquor from the house of one Ram Chandra Sharma and petitioner happens to be the son of Ram Chandra Sharma. Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case and in fact there is no recovery from the possession of the petitioner. Further, the petitioner is having no criminal antecedent and is in judicial custody since 06.01.2020.

Heard learned A.P.P. who has opposed the prayer for bail.

Case No. 521 of 2019.
