====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 19-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bahadurganj P.S. Case No. 157 of 2018 (Sessions Trial No. 158 of 2018), instituted for the offence under Section(s) 302, 201 and 34 of the Indian Penal Code.

It is alleged in the written report that daughter of the informant got traceless. The informant made search and learnt that one dead body is lying near Kabristan. The informant went there and identified the dead body of his daughter. He raised suspicion against petitioner of committing murder of his daughter due to love affair.

Counsel for the petitioner submits that besides such suspicion, there is no allegation of any specific overt act

Patna High Court Cr.Misc. No.9876 of 2019(2) dt.19-02-2019 2/2 against the petitioner.

Petitioner is in custody since 23.5.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Kishanganj, in connection with Bahadurganj P.S. Case No. 157 of 2018 (Sessions Trial No. 158 of 2018), subject to the condition that both the bailors will be the close relatives of the petitioner.
