PANCHOLI) 28-02-2025 The present petition has been filed for restoration of miscellaneous appeal, i.e., M.A. No.20 of 2018.
2. Heard Mr. Rajesh Mohan, learned counsel for the petitioner.
3. Learned counsel for the petitioner submits that this Court passed an order dated 25.04.2019 by which the petitioner was permitted to remove the defect(s), by 06.05.2019 with further observation that if the defect(s) are not removed within the stipulated time, the petition shall stand dismissed. He further submits that the petitioner could not remove the defect(s) within stipulated time and, therefore, the miscellaneous appeal filed by
Patna High Court MJC No.247 of 2022(4) dt.28-02-2025 2/2 the petitioner stood dismissed.
4. Learned counsel for the petitioner, by referring to the averment made in the petition, submits that now, the petitioner will remove the defect(s), as pointed out by the office, within a period of six weeks' from today.
5. In view of the aforesaid submission, the miscellaneous appeal, i.e., M.A. No.20 of 2018 stands restored with a condition that the petitioner shall now remove the defect(s) within a period of six weeks' from today. (Vipul M. Pancholi, J.) (Prabhat Kumar Singh, J.) Anay, Gaurav Kumar/- U
