The petitioner is languishing in custody since 29.03.2014 in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. It is alleged that co-accused Rambabu Sah and three others including the petitioner came and took the husband of the informant from her daughter's place and subsequently Rambabu Sah informed the informant that her husband died and dead body was reached to the house. The suspicion was raised against the petitioner and Rambabu Sah since there was dispute between Rambabu Sah and the victim for non-

Patna High Court Cr.Misc. No.29259 of 2014 (05) dt.02-02-2015 2/2 supply of the labour in spite of receiving money by the victim, who was a labour contractor.

It is submitted by learned counsel for the petitioner that the victim died due to accidental death and only on suspicion the accusation has been levelled. Subsequently the informant has retracted from the initial version and filed a petition to that effect before the learned court below. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sikrahana, East Champaran at Motihari in connection with Patahi P.S. Case No. 113 of 2012.
