2. The petitioner is apprehending his arrest in connection with Rajgir P.S. Case No. 472 of 2023 for the offence under section 304(B)/34 of the Indian Penal Code lodged on 14.09.2023 by the informant, Manoj Majhi.

3. As per the prosecution story, the informant alleged that his daughter was married to Rudal Majhi in the year 2013 but was tortured for dowry, and later on 14.09.2023, the news came of her death. The informant has suspicion that she has been murdered. This led to the FIR.

4. Learned counsel for the petitioner submits that Rudal Majhi was arrested, remained in jail for one year and has been granted bail by a Co-ordinate Bench of this Court on 08.07.2026, vide Cr. Misc. No. 10020 of 2026. So far as the

Patna High Court CR. MISC. No.10078 of 2026(5) dt.08-07-2026 2/3 cause of death is concerned, learned Sessions Judge order would show that it has been recorded as asphyxia due to hanging, the petitioner is the sister-in-law (Gotni), living separately and had no role to play in the matter.

5. Learned APP opposes the prayer submitting that allegation is against the entire family member.

Considering the submissions aforesaid as also that the petitioner is a lady, the cause of death has been recorded as asphyxia due to hanging, the husband has been released on bail as recorded above, in that background, this Court is inclined to extend him the privilege of anticipatory bail with conditions.

7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M. Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 472 of 2023 subject to the following conditions:

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document (Aadhaar Card/Voter ID Card/Pan Card/Driving License) to show his/her bona fide;

Patna High Court CR. MISC. No.10078 of 2026(5) dt.08-07-2026 3/3 (ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) munindra/- U T
