The petitioner, who is in custody since 14.6.2015 in connection with Bettiah Muffasil (Manuapul ) P.S. Case No.163 of 2015 registered for the offence punishable under Section 147,148, 149, 323, 307, 302 & 504 of the Indian Penal Code has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that there was case and counter case and in the occurrence petitioner had also received serious injury. His hand was got fractured in the occurrence. It has also been argued that petitioner is an elderly person aged about 70 years. On the aforesaid grounds a prayer has been made for grant of bail.

Patna High Court Cr.Misc. No.52111 of 2015 (2) dt.02-12-2015 2/2 Besides hearing learned counsel for the parties, I have also perused the materials available on record. On perusal of the F.I.R. itself it is evident that there is specific accusation against the petitioner. In the F.I.R. petitioner's age has been disclosed as 55 years.

Be that as it may, keeping in view the fact that there is direct accusation against the petitioner, I do not find it a fit case for grant of bail.

The petition stands dismissed.
