2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307, 504, 506/34 and other allied sections of the Indian Penal Code.
3. As per the prosecution case, petitioner assaulted the informant with iron rod causing head injury.
4. Learned counsel appearing for the petitioner submits that there is land dispute between the parties. There is case and counter case in which both sides sustained injuries. Doctor has found simple injury. Other co-accused, with similar allegation, have already been allowed pre-arrest bail by this Court vide order passed in Cr.Mis.No.73114/2023. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of
Patna High Court CR. MISC. No.12757 of 2024(2) dt.12-03-2024 2/2 arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Jhanjharpur, Madhubani in Ghoghardiha Police Station Case No. 95 of 2003/GR No.1060 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
