JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-04-2023 The present writ petition has been filed seeking the following relief:- "That the present writ petition is being filed for issuance of a writ in the nature of mandamus commanding the respondents to take appropriate steps for removal of encroachment by the private respondent no. 6 upon the governmental sewerage (DAND) resulting into obstruction in free flow of water in the sewerage resultantly causing unhygienic condition and its related complication to the residents of that area."
Patna High Court CWJC No.17410 of 2016(2) dt.06-04-2023 2/2 At the outset, learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Banka for redressal of his aforesaid grievances. Liberty so sought is granted.
It is needless to state that in case, the petitioner approaches the Circle Officer, Banka by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law, and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.
The present writ petition stands disposed off on the aforesaid terms.
