The petitioner is languishing in custody for the offences punishable under Sections 498A and 304(B) of the Indian Penal Code.

Petitioner is husband of the victim of death. Death was caused allegedly for non-fulfillment of dowry demand after 10 years of marriage.

Submission is that presumption of dowry death is not against the petitioner and there is no evidence of occurrence of murder.

Submission is that though allegation is of throttling, however, the doctor has found head injury as cause of death.

No.8905 of 2019(3) dt.11-04-2019 2/2 Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with S. Tr. No. 428 of 2018 arising out of Nawada Nagar P.S. Case No. 462 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
