Petitioner seeks bail in connection with Sessions Trial no. 186/2020 arising out of Kotwali (Tilkamanjhi) P.S. Case no. 172 of 2020 registered for the offence punishable under sections 302, 380 and 120B/34 of the Indian Penal Code. Learned counsel for the petitioner after some argument seeks permission to withdraw the case as out of eight witnesses, three witnesses have been examined. Permission is accorded. Learned court below is directed to ensure that the trial is completed within 14 months from today.

The Superintendent of Police, Bhagalpur is directed to ensure that official witness is produced before the learned court

Patna High Court CR. MISC. No.19627 of 2021(3) dt.15-12-2021 2/2 below as and when required by the court and in the event it would come to the notice of the court that official witness despite being summoned by the learned court below has not appeared, consequences would be severe.
