2. The petitioner is in custody in connection with Aurangabad Town P.S. Case No. 485 of 2023 registered for an offence punishable under Sections 401, 420, 468 and 471/34 of the Indian Penal Code.

3. As per prosecution case, the allegation against the petitioner is that he started fleeing from SBI Branch, Ramesh Chawk, Aurangabad and after being chased he was caught.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that petitioner has been implicated only on suspicion

Patna High Court CR. MISC. No.12910 of 2024(2) dt.29-02-2024 2/2 and petitioner has got clean antecedent as stated in para-3 of the petition and he is in custody since 19.07.2023.

5. Learned APP for the State opposes the prayer for regular bail of the petitioner.

6. On perusal of the first information report and seizure list, it appears that no seizure list made by the police personal and is not available on record. The other co-accused, namely, Pawan Yadav on similar allegation has already been granted bail by the trial Court, in these circumstances, the prayer for bail of the petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Aurangabad in connection with Aurangabad Town P.S. Case no. 485 of 2023/G.R. No. 1909 of 2023.
