The petitioner seeks bail in connection with Didarganj P.S. Case No. 335 of 2022 registered for the offence under Sections 30(a), 32(ii)(iii), 36, 41(1)(2) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the petitioner is in custody since 30.11.2022 and there is recovery of 3609 litres of country made foreign liquor from his possession and he has one antecedent.

Learned APP has vehemently opposed the prayer of bail.

Patna High Court CR. MISC. No.16616 of 2023(2) dt.16-05-2023 2/2 Considering the period of custody and recovery of liquor from his possession, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna City, Dist-Patna in connection with Didarganj P.S.
