The petitioners apprehend their arrest in connection with Chiraiya P.S. Case No.335 of 2018 registered under Sections 341, 323, 324, 308, 379, 504 and 506/34 of the Indian Penal Code. The accusation is that in the evening of 11.08.2018, when the informant Arvind Kumar reached at his house then saw that his Pattidars were carrying the log of Shisham wood of his share. When the informant made protest then the petitioners attacked on him. At that time, the petitioner no.2 gave axe blow at his forehead causing blood oozing injury. Petitioner no.1 pressed the neck of the inforamnt by putting Gamachha. Petitioner no.3 snatched the gold

Patna High Court CR. MISC. No.8883 of 2019(4) dt.14-05-2019 2/2 Hanumani worth Rs.8000/-from the neck of the informant. Learned counsel for the petitioners submits that, admittedly, the petitioners are Pattidars of the informant and the alleged occurrence took place on account of share of log of Shisham wood. Moreover, the injury as found on the person of the informant is simple in nature, which is attributed to the petitioner no.2. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Chiraiya P.S. Case No.335 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
