====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Majorgunj P.S. Case No. 140 of 2019 for the offenses under Section 30(a) of the Bihar Prohibition & Excise Act, 2016. Learned counsel for the petitioner submits that in the instant case total 30.6 ltrs of Nepali Saufi Wine was recovered from the motorcycle. Nothing was recovered from the conscious possession of the petitioner. The petitioner is remanded in the instant case on 19.12.2019.

Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-

Patna High Court CR. MISC. No.7631 of 2020(2) dt.05-02-2020 2/2 (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II cum Special Judge (Excise), Sitamarhi, in connection with Majorgunj P.S. Case No. 140 of 2019. However, in the event the petitioner is found involved in similar cases in future, the court below shall be at liberty to cancel the bail bonds of the petitioner in the present case.
