The learned Sessions Judge has reported vide letter no. 3198 of 2015 dated 29.12.2015 that this Court vide order dated 04.11.2015 passed in Cr. Misc. No. 46307 of 2014 extended the period for conclusion of trial of the petitioner for further five months. It has also been reported that the trial of the petitioner is only pending for want of FSL report for which letters have already been issued to the Director Custom House, ( Kolkata) Chemical Laboratory Kolkata as well as Superintendent of police, Nawada. In the aforesaid circumstances, I do not feel it proper to release the petitioner on bail and hence, his prayer for bail in connection with Special Case No. 03 of 2013, arising out of Nawada Town P.S.Case No. 265 of 2013, pending in the court of
Patna High Court Cr.Misc. No.53394 of 2015 (3) dt.27-01-2016 2/2 Sessions Judge, Nawada is again rejected.
However, a copy of this order be sent to the Director Custom House, (Kolkata) Chemical Laboratory ( Kolkata) with direction to send FSL report of the above stated case directly to the court of Sessions Judge, Nawada within two weeks from the date of receipt / production of copy of this order and after receipt of the aforesaid report, the learned Sessions Judge, Nawada must conclude the trial of the petitioner as early as possible without any delay.
