====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 20-03-2024 Heard Mr. Arvind Kumar, learned counsel appearing on behalf of the petitioner and Mr. Ramchandra Sahni, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Baruraj P.S. Case No. 76 of 2023 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Learned counsel appearing on behalf of the petitioner has renewed his prayer for pre-arrest bail under the circumstances that the petitioner was granted pre-arrest bail vide order dated 30.08.2023 passed in Cr. Misc. No. 57283 of 2023 but the bail bond of the petitioner could not be accepted by the District Court after it was found by the District Court that information with regard to the criminal antecedent of the

Patna High Court CR. MISC. No.11860 of 2024(2) dt.20-03-2024 2/2 petitioner given in Para-3 of the bail application was incorrect and now the petitioner has given correct information with respect to the number of cases pending against him.

4. Considering the aforesaid information, the petitioner who has been made accused under Section 30(a) of the Bihar Prohibition and Excise Act for alleged recovery of 171 litres of foreign liquor is directed to be released on pre-arrest bail on similar terms and conditions and the reasons assigned in the order dated 30.08.2023 passed in Cr. Misc. No. 57283 of 2023.

5. The time for surrender is extended for a further period of three weeks.

6. The bail application stands disposed of.
