JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-01-2018 The petitioner, by way of the present writ petition, seeks relaxation for appearing in the physical test in which, he could not appear on the appointed day.

An advertisement no. 3 of 2015 was issued, seeking recruitment of candidates on the post of Clerk-cumTypist, by the Railway Recruitment Board, Allahabad. The petitioner had applied for the said post and thereafter, Admit card/ call letter was issued to him. The petitioner had appeared in the examination and was declared successful whereafter, the respondents had called the candidates for skill test on 29.05.2017, however the petitioner did not appear on the said appointed day for skill test.

Patna High Court CWJC No.851 of 2018 (2) dt.17-01-2018 2/2 The learned counsel for the petitioner submits that since the petitioner was ill, he could not appear in the skill test on 29.05.2017, as such he may be granted one chance to appear in the physical test so that on his competence, he can be appointed as Clerk-cum-Typist.

I have perused the materials on record and find that the petitioner was not present on the date of physical test i.e. on 29.05.2017. It is apparent that the petitioner had not appeared for physical test on the appointed date i.e. on 29.05.2017, hence this Court is helpless in providing any relief to the petitioner since the recruitment process is also over and several months have lapsed thereafter.

In view of the latches on the part of the petitioner himself, no relief can be provided to the petitioner. However, in the interest of justice, it is directed that in case, the petitioner approaches the concerned authority within two weeks from today by filing a representation, the concerned authority may consider his representation on humanitarian ground in accordance with law.
