This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Hathidah PS Case No. 82 of 2018 for the alleged offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is that in the instant case total 1074.60 liters of liquor was seized from a pickup van. Learned counsel representing the petitioner submits that petitioner has no criminal antecedent. Petitioner is neither the owner of the van nor is the owner of the liquor. He further submits that petitioner is in custody since 29.10.2018.

Considering the aforesaid circumstances, this

Patna High Court Cr.Misc. No.10838 of 2019(2) dt.22-02-2019 2/2 application is allowed. Accordingly, let the petitioner above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Hathidah PS Case No. 82 of 2018.
