The petitioner apprehends his arrest in Aurangabad (Muffasil) P.S. Case No. 232 of 2021, registered for the offences punishable under Section 394 of the Indian Penal Code. As per the prosecution case, three unknown miscreants riding on motorcycle came and one of them assaulted the informant by irod rod. The accused persons also looted the motorcycle of informant.

It is submitted that petitioner is not named in the FIR. Name of petitioner transpired during course of investigation in the confessional statement of co-accused Rama Kumar. Petitioner claims clean antecedent.

Patna High Court CR. MISC. No.9326 of 2022(2) dt.04-08-2022 2/2 Learned counsel appearing for the State opposes the prayer for bail. He submits that during investigation accused Rama Kumar has confessed that he and other accused persons handed over the stolen motorcycle of the informant to this petitioner who kept the same in his house. Petitioner has got criminal antecedent.

Considering the specific allegation against the petitioner, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice. (Prabhat Kumar Singh, J) shashi/- U T
